The Order of Service (O.O.S) relates to your Gateway Logisitics Services Provider contract for services.
It is the customers responsibility to ensure correct shipping and consignee information is provided. Any charges associated with incorrect information on the O.O.S is the responsibility of the customer. Notice: The Bill of Lading and all its terms and conditions, and estimated charges are incorporated by reference into the Order of Service in accordance with 49 CFR 375.505 (a)
Power of Attorney: The O.O.S grants authority (Power of Attorney) for the Gateway Services Group of companies, its employees and or agents the Power to sign and enter into crating and transportation agreements on behalf of the requesting party. By signing this O.O.S the requesting party acknowledges that they are the USPPI or BCO or an authorized individual for the materials/product being packed and/or shipped.

Filing of Claims/Complaint Procedures: Gateway Crate and Freight LLC shall not be liable for the loss or destruction of, or missing goods, or damage of goods tendered here under or any part thereof, unless claim is made in writing and supported by proof of ownership, together with substantiation of value, and weight. As a condition precedent, all outstanding moneys due to the carrier must be paid in full before a claim can be submitted to said carrier within nine (9) months after the date the goods are delivered or demand thereof refused and must be limited the destination descriptions of damage indicated on the bill of lading or inventory at time of delivery. Valuation of claim will be based on those indications subject to the limitations of liability as described on the Bill of Lading. To File a Claim call Gateway O.T at 855-474-4685
Summary of Dispute Settlement Program: Gateway O.T and claimant agree to participate in a neutral arbitration program designed to give neither the carrier nor the customer any special advantage. Each Party is responsible for their own costs associated with arbitration.
Agreed Pickup and Delivery Schedule: Gateway O.T is required to pick up and deliver with reasonable dispatch and in a reasonable time. Any oral promises made regarding delivery or pick up dates and times are only estimates. This time frame may change based on weather, road and traffic conditions, other acts of God, delivery schedule, geographic location and other unknown factors. Gateway O.T will do our best to meet scheduled pickup and delivery dates and times.
Self Pack: My Items tendered to Gateway do not contain any Hazardous, illegal, prohibited or restricted material as outlined in USPS Pub 52.
EUV: Exclusive Use Vehicle refers to the service where the BOL and O.O.S contract specifically references that the materials/products tendered to Gateway O.T are to be transported Exclusively with no other freight. Gateway Optimum Transportation is a Shared Truckload services company. Signor agrees that products/materials can be transported or shipped consolidated with other freight. If the customer is asking for Exclusive Use Service this request must be documented in the Order of Service and on the BOL.
Non-Binding Estimate: A Non-Binding estimate is not a bid or a contract. It is provided by Gateway O.T to give you a general idea of the costs of the service. It does not bind Gateway O.T to the estimated cost. It is not a guarantee that the final costs will not be more than the estimate. Final charges will be based on the actual time spent and materials used and designated in the Non-Binding Estimate.
Sever ability: If any part of this contract is found to be unlawful or invalid, the remaining terms and conditions shall still be enforceable.
Prohibited Domestic shipment Items: Air bags, Alcoholic Beverages, Ammunition, Explosives, Gasoline, Marijuana (medical or otherwise).
Prohibited International shipment items: Aerosols, Air bags, Alcoholic Beverages (or items containing any trace of alcohol whatsoever), Ammunition, Cigarettes, Dry Ice, Explosives, Fresh Fruits & Vegetables, Gasoline, Hand Sanitizers, Marijuana (medical or otherwise), Mouthwash, Nail Polish Perfumes (containing alcohol), Poison
These Domestic Restricted Items must be disclosed in order to ensure regulations, packing requirements and particular guidelines are met: Aerosols, Cigarettes and Tobacco, Cremated Remains, Dry Ice, Firearms, Glues, Lithium Ion Batteries, Matches, Nail Polish, Paint, Perfumes, Perishable Items, Poisons, Prescription Medicine or Drugs.
These International Restricted Items must be disclosed in order to ensure regulations, packing requirements and particular guidelines are met: Cigars, Lithium Ion Batteries, Medical Devices, Medicine or Drugs
Agreed Mandatory Choice of Law, Venue and Jurisdiction: If a lawsuit becomes necessary to resolve any dispute between Gateway O.T and the customer said suit shall and must only be brought in circuit or county court in and for Maricopa County, Arizona. Suits involving disputes over interstate shipments must be limited to the governing federal law. Both parties agree to submit themselves to the jurisdiction of the Arizona Courts and agree given the relationship to the state, such exercise is reasonable and lawful. Customer consents to jurisdiction in Maricopa County, Arizona and hereby waives the right to be served within the State of Arizona.
Form of Payment: All payments for crating, packing and shipping must take place prior to shipping and can be paid by credit card, cash or check. All Credit Card processes are charged a 3% fee as noted above. Customer is responsible for all charges associated with any returned check fees. Terms can be established but customer must provide credit references and agree to pass credit check. Weekly Storage Fees start accruing on the 5th business day following completion of packing/crating for cargo that has not been paid for and/or picked up from our warehouse.
Inside Delivery Service: Service includes inbound warehouse handling, storage, outbound warehouse handling, minor disassembly, reassembly and debris removal. Additional charges may apply after completion of the Inside Delivery Service at the discretion of the agent. Inside Delivery agents provide free basic limited liability protection ranging from .30 to .60 per lb. If optional Full Replacement Value Protection (RVP) is not offered by the agent for an additional cost, additional coverage above the limited liability protection would be your responsibility. Any claim for loss or damage made above the .30 to .60 a pound liability is between you and the Inside Delivery agent or the Insurance carrier and does not hold Gateway O.T. liable or responsible for any loss or damages. By signing this Order of Service, you agree to these terms and conditions.
Cargo Line Haul Insurance: Gateway Crate and Freight LLC liability by law covers shipments at only .60 a lb. If your declared value is Greater than this amount, additional insurance can be purchased for transportation of the goods by the customer. This is made available for a fee through Gateway O.T carriers and can be included on this quote. Any claim for loss or damage made above the .60 a pound liability is between you and the freight company or the Insurance carrier and does not hold Gateway Crate and Freight liable or responsible for any losses. Any issues involving the performance of this service must be addressed during the time of service in writing.
Insurance: Gateway carries a $1,000,000.00 liability policy that only covers items on site and off site during storage or packing.
The customer (or his/her representative) by his/her signature hereby orders the services outlined herein to be performed on his or her behalf. Customer has read, clearly understands, and agrees to ALL of the terms and conditions of the Order of Service and the Bill of Lading.

All Credit Card processes are charged a 3% fee as noted above. Customer is responsible for all charges associated with any returned check fees. Credit Card charge backs will become valid Invoices that must be paid for by Money Order, Cashier Check or wire transfer. Unpaid Invoices will receive an added non Payment charge of $35 every 30 days that the Invoice becomes Past Due. Weekly Storage fees will accrue on the 5th business day following completion of packing/crating for cargo that has not been paid and/or picked up from our warehouse..
